The quiz tournament events of the website www.JananasGold.com are operated by Janana’s Gold OG, Gartenstadtstr. 9, 4048 Puchenau (hereinafter referred to as "the company").

The company reserves the right to amend the contents of these General Terms and Conditions at any time. Every time the user launches a client application, regardless of the medium used (via internet or via our mobile services), opens an account, uses and reuses such an account, participates in any of the offered services or accepts any prize, the user accepts the current version of the General Terms and Conditions and agrees to abide by these General Terms and Conditions, including any revisions which may periodically take place. At least once a month, the user agrees to review the General Terms and Conditions on the website: www.JananasGold.com

In the event of any discrepancies due to translation or interpretation, the English version of the Terms and Conditions shall prevail.

Eligibility

To open a Janana´s Gold account and/or to participate in any tournament offered, the user must (1) be a natural person, at least 18 years of age or older if required in the user’s locality; and (2) be physically located in a country in which participation in the tournaments offered is unrestricted by law. The rules governing competitions, contests, and tournaments with entry fees and/or prizes are set up by each individual country and/or local government. It is the user’s responsibility to participate in tournaments only if participation is not restricted or prohibited by the user’s country of residence.

Username

The user must choose a username on completion of registration. The user is responsible for all actions taken under that username and shall only use or utilize the service using the user’s own username. We recommend that the user chooses a sensible/memorable username and password and keeps them securely. The user must make every effort to keep his password safe and should not disclose it to any third party. The company is not responsible or liable for any losses or problems the user suffers as a result of the disclosure of the username to third parties. The user must not choose a username that is offensive to other players. The company reserves the right to close any user account with a username that is reasonably considered to be offensive.

Accounts

Only one account is permitted per user. You may not use the service by means of another person's account. Should you attempt to open more than one account, under your own name or under any other name, or should you attempt to use the service by means of any other person's account, the company, is entitled to immediately close all of your accounts and bar you from future access to the service.

On the company’s request, the user is obliged to produce an official document showing his photo, proving his identity (a passport copy, driver's licence or identity card).

Complaints against account statements and the balances shown in them must be made within 14 days after the account balance becomes available on the company’s website (via e-mail to the respective support). A failure to make such a complaint is deemed to be an agreement to the mentioned account balance. The company reserves the right to rectify obvious errors when preparing account balances. The company will inform the respective users of the corrections immediately.

The user agrees to the storage and automation aided use of his personal data given to the company in the course of the registration or during the usage of the service and the website www.JananasGold.com. No data will be passed on to 3rd parties unless otherwise stated or due to the force of the law. The company reserves the right to inform users about special promotions or new products by telephone or e-mail, as well as the right to offer help pro-actively, as long as the user has not explicitly requested not to be contacted in this way. The user has the right to request not to be contacted at any time without notification of reason. Please note, that due to administrative reasons, it could take up to 48 hours for this request to be processed.

Users hereby accept that all times listed on the website are understood to be in the time zone "GMT+1" unless otherwise stated.

Tournaments & Event Tickets

Purchased Tournament Event Tickets are valid for a period of 12 months, starting with the day of the purchase. Marketing Bonuses and Price-Off Event Tickets are valid for a periode of 3 months starting with the issue day and have to be used within this time periode. Once purchased Tournament Event Tickets will not be refunded.

The user should ensure to have read and understood the rules of the each individual tournament available through the service. The user agrees to abide by the rules of each of the tournaments as published and periodically changed on the site. These tournament rules form part of the terms and conditions under which the user plays. The company reserves the right to determine the results and winners of each of the tournaments. By registering and/or participating in any tournament the user agrees to be bound by these determinations. The list(s) of winners may be posted on the site following each tournament. The company reserves the right to publish the results using the participant’s usernames and pictures on the site as well as on other websites and offline media.

As an end user, you are not allowed to affect the outcome of any tournament and manipulate the result by any other means than those provided within the tournament. In the event that the company deems you to have tried to manipulate the game result, it will take any rectifying action it sees fit including immediately blocking access to the service by the offending user, terminating such user's account and / or seizing all monies or tokens in any kind held in the relevant user account.

The answers to the quiz questions are edited by the company upon best knowledge. Should different sources provide different answers or solutions to the quiz one or more questions in a tournament, the sources used by the company shall be the ones to decide about the correct answer for the tournament. Decisions of the company are final and no subjet to legal prosecution whatsoever.

Technical errors

System Failure

In the event of a server crash or system failure that disrupts a tournament in a relevant way, the purchased Tournament Event Tickets will be valid for the upcoming and unpaid Event.

Connection Issues

All players are personally responsible for the stability of their internet connections. The company is not liable for any losses, which may occur in this context. Should the user’s internet connection drop, the tournament will proceed.

Cheating / Use of Artificial Intelligence

The company is committed to fair play and to combating fraudulent activity, and has zero tolerance towards inappropriate and fraudulent activity. Any form of cheating, at the sole discretion of the company, is strictly prohibited. Cheating includes any form of manipulation of the outcome of a tournament. In addition to any other remedies provided under these Terms of Service, the company may pursue claims for criminal prosecution and/or civil damages for any form of cheating.

The user is not allowed to use any software program endowed with artificial intelligence, including without limitation a robot, in order to assist the user in the use of the service. In the event that the company deems it has been used, the company reserves the right to take any action it sees fit, including disqualifying the user from the given tournament, immediately blocking access to the service to the offending user, terminating such user's account and seizing all monies held in such account.

The user agrees not to attempt to exploit any error, virus, bug, defect or inconsistency (“Bug”) found in the Software, to the user´s advantage, or to the disadvantage of other users, at any time. Furthermore, the user agrees to report any such Bug to customer service immediately upon discovery of the same.

Intellectual Property

The user acknowledges and agrees that the information found on the service and the technology driving it is a trademark of the company, a service mark, copyright, trade secret, patent and/or a proprietary right (collectively "Intellectual Property"). The user agrees not to rent, lease, loan, distribute, create derivative works, copy, re-use, modify, adapt, attempt to decompile, decipher, disassemble, reverse engineer, decrypt or discover the source code of all or any portion of this site, deploy any type of query program on the site, create improvements, or seek to obtain intellectual property protection on the content found on the site.

Governing Law

The terms and conditions relating directly to the tournament service shall be governed by and construed in accordance with Austrian law and subject to the non-exclusive jurisdiction of the Austrian courts.

Termination

The company may terminate the user’s account (including the username and password) if (1) the user has breached any of these terms and conditions, (2) the use of the service has been in any way improper or breaches the spirit of this agreement, or (3) for any other reason that the company sees fit.
